Acceptable Use Policy

Purpose and Scope

This Acceptable Use Policy (the Policy) explains how ERNIE-Image may and may not be used. It applies to all prompts, uploads, reference materials, generated outputs, shared links, account activity, API requests, and other use of the Service.

This Policy forms part of our Terms of Service. If this Policy conflicts with the Terms, the more protective rule for users, third parties, and platform safety will apply to the extent permitted by law.

Lawful and Authorized Use

You may use ERNIE-Image only for lawful purposes and only with content you have the right and authority to submit. You are responsible for confirming that your prompts, uploads, reference materials, intended outputs, and downstream use comply with applicable law and third-party rights.

Do not use the Service to create, edit, upload, request, publish, distribute, sell, or otherwise use prohibited content.

Prohibited Content and Conduct

The following content and uses are prohibited:

Sexual Content and Exploitation

• pornographic, sexually explicit, fetish, or sexually exploitative content
• non-consensual intimate imagery, voyeuristic content, revenge pornography, or sexual deepfakes
• sexual services, sexual solicitation, trafficking, or content that facilitates sexual exploitation

Child Safety

• any sexualized, nude, suggestive, exploitative, abusive, or grooming-related content involving an actual or apparent minor
• attempts to make an adult appear to be a minor in a sexual context, or a minor appear to be an adult for a sexual purpose
• content that facilitates child exploitation, trafficking, grooming, or evasion of child-safety controls

Suspected child sexual abuse material must not be downloaded, copied, or emailed. Report the URL or task identifier immediately using the reporting process below.

Deception, Impersonation, and Deepfakes

• deceptive impersonation, fabricated evidence, forged documents, fake identity materials, scams, fraud, or misinformation intended to cause harm
• realistic media that falsely depicts a person as saying or doing something material without authorization or appropriate disclosure
• impersonation of public officials, political candidates, government entities, companies, or private individuals for fraud, manipulation, harassment, or reputational harm
• undisclosed synthetic media used for political persuasion, election interference, or materially misleading public communications

Hate, Harassment, and Abuse

• hate speech, discriminatory abuse, dehumanizing content, or attacks based on protected characteristics
• harassment, bullying, stalking, threats, doxxing, blackmail, humiliation, or targeted intimidation
• content designed to expose private information or facilitate harm against an individual or group

Violence and Self-Harm

• graphic gore, torture, glorification of violent wrongdoing, terrorism, or extremist recruitment
• credible threats or instructions intended to facilitate violence or serious physical harm
• content that encourages, instructs, or celebrates suicide, self-harm, or eating-disorder behavior

Illegal Activity and Safety Evasion

• illegal goods or services, criminal activity, trafficking, or instructions that materially facilitate wrongdoing
• malware, credential theft, phishing, unauthorized surveillance, or attempts to compromise systems or accounts
• attempts to bypass moderation, rate limits, account restrictions, payment controls, or other safety mechanisms
• repeated prompt variation or obfuscation intended to evade a blocked-content decision

Intellectual Property, Privacy, and Publicity Rights

• content that infringes copyright, trademark, trade dress, privacy, publicity, personality, reputation, or other third-party rights
• unauthorized use of confidential information, private images, personal data, or protected creative work
• false claims that an output, product, model, or service is officially endorsed by a third party

Identity Manipulation and Face or Head Replacement

Public face-swap and head-swap products are temporarily unavailable while we complete a compliance review.

If identity-manipulation features are offered again, they may be used only when the user has documented permission from every identifiable person depicted. They must not be used with minors, public figures, sexual or intimate content, deceptive impersonation, fraud, political persuasion, harassment, or any purpose that could mislead a reasonable viewer about a person's identity or conduct. We may require rights confirmation, safety labels, watermarking, or additional review before processing or delivery.

Moderation and Human Review

We use layered safety controls to identify and respond to prohibited use. These controls include:

• automated moderation of prompts and supported uploaded inputs before processing
• automated moderation of generated image outputs before delivery
• automated or human review of other media where the relevant control is available, together with post-delivery reporting and removal processes
• safety rules and blocklists that are reviewed and updated as abuse patterns, provider requirements, and legal obligations change
• risk signals based on account activity, repeated violations, metadata, and attempts to evade controls
• human review of selected flagged cases, user reports, appeals, and high-risk activity
• limited moderation and enforcement logs retained in accordance with our Privacy Policy and legal obligations

No moderation system is perfect. A failure to detect content does not make that content permitted. We may review, restrict, remove, or preserve content after generation or publication when we receive a report or identify a risk.

Publicly shared or gallery content may be reviewed after publication and removed without prior notice when it violates this Policy.

Enforcement

Depending on severity, context, and account history, we may:

• block a prompt, upload, request, or output
• require additional information, consent confirmation, or human review
• remove content or disable a hosted or shared link
• restrict features, credits, payments, or account access
• suspend or terminate an account
• preserve relevant records and report conduct to payment providers, rights holders, regulators, or competent authorities where required or appropriate by law

Severe child-safety, exploitation, fraud, or imminent-harm violations may result in immediate termination and reporting without prior warning.

Reporting Prohibited Content

Report suspected violations to support@ernie-image.app. Include, where available:

• the relevant page URL, task identifier, or account identifier
• a concise description of the suspected violation
• whether you are depicted in the content or acting for a rights holder
• a reliable way for us to contact you

Do not attach suspected illegal media. Reports involving child safety, non-consensual intimate imagery, trafficking, or immediate risk of harm receive priority.

Appeals

If your content or account was restricted and you believe the decision was incorrect, email support@ernie-image.app with the relevant task or account identifier and the reason for your appeal. A person depicted in generated content may also request removal and review of any claimed consent.

Appeals may be reviewed by a person who was not responsible for the initial automated decision. Repeated, abusive, or clearly unfounded appeals may be closed without further review.

AI Disclosure and User Responsibility

Generated media should be identified as AI-generated when a reasonable viewer could otherwise mistake it for authentic media or when disclosure is required by law, platform rules, or the context in which it is used. You must review outputs before publication and must not remove safety labels or disclosures for a deceptive purpose.

Age Requirements

Users must be at least 13 years old. Users under 18 may use the Service only with permission and supervision from a parent or legal guardian. Certain higher-risk features may require additional age or identity verification.

Changes and Contact

We may update this Policy as our services, safety controls, legal obligations, and provider requirements change. The current version becomes effective when posted unless otherwise stated.
